You agree that information displayed on this Site is for personal use only and may not be sold, redistributed or used for any commercial avenue (this includes but is not limited to the use of all Advertiser details for unsolicited commercial correspondence). You may download items from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other notices.
Copyright & Intellectual Property
Copyright in the material and trademarks on this Site are owned by applyfirst.ca unless otherwise indicated and you agree not to infringe any intellectual property rights owned by applyfirst.ca
You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this Site including code and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms of use.
Prohibited Use
You may not:
- Use data mining, robots, screen scraping, or similar data gathering and extraction tools on this Site for establishing, maintaining, advancing or reproducing information contained on our Site on your own website or in any other publication, except with our prior written consent.
- Post any jobs on applyfirst.ca for any competitor of Applyfirst.ca or post jobs or other content that contains links to any site competitive with applyfirst.ca
- Post jobs or content on taveljobs.biz that contain hyperlinks, “hidden” keywords or keywords that are irrelevant to the job or are otherwise misleading
- Use any applyfirst.ca jobseeker database for any purpose other than as an employer seeking employees, including but not limited to using the information in the applyfirst.ca jobseeker database to sell or promote any products or services.
- Post or submit any incomplete, false or inaccurate biographical information or information which is not your own.
- Post on applyfirst.ca any franchise, pyramid scheme, “club membership”, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (except for postings that make clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling, in which case such postings are permissible), or requires recruitment of other members, sub-distributors or sub-agents.
- Send unsolicited mail or e-mail, make unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to a User of applyfirst.ca.
- Delete or revise any material posted by any other person or entity.
- Violating or attempting to violate the security of the Site, including, without limitation:
- accessing data not intended for such User or logging into a server or account which the User is not authorized to access.
- Attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization
- Attempting to interfere with service to any User, host or network, including, without limitation, via means of submitting a virus to the Site, overloading, “flooding”, “mailbombing” or "crashing.
Violation of these 3 points in particular may result in civil or criminal liability.
User Information
To become a registered user, you must provide a password and a login name. Users acknowledge that they are entirely responsible for maintaining the confidentiality of their passwords and login name and are entirely responsible for any and all activities that occur under their login name. You may change your password at any time by following instructions. You may also change your login by contacting us, and may also delete services attached to your registration if necessary.
You agree to immediately notify applyfirst.ca of any unauthorized use of your login name or any other breach of security known to you. You agree that it is a condition on your use of the applyfirst.ca that you will not either through any act (including but not limited to posting a resume of the applyfirst.ca Site) or omission mislead or deceive others.

Information on the site does not represent professional advice, you acknowledge and agree that information published by applyfirst.ca is intended to provide general information in summary form on legal and other issues.
Applyfirst.ca accepts no responsibility and is not liable for the content of any job notices as they appear on the Site. Users acknowledge that applyfirst.ca has no control over and is not liable for the quality, safety or standard of positions advertised on the Site or the truth or accuracy of the information contained in the job notices. Any illustrations or photographs displayed on the Site are solely for the guidance of prospective candidates and are not to be relied upon.
In no event will applyfirst.ca be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the Site.
Applyfirst.ca gives no guarantee of continued availability of any particular job advertised on the Site and will not be liable to you should an employer have filled the vacancy at any time.
Whilst applyfirst.ca takes efforts to ensure that jobs advertised are for actual job vacancies, it gives no guarantee to you that every job advertisement represents an actual job vacancy.
Disclaimer of Consequential Damages
YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE, THE INTERNET GENERALLY, AND THE DOCUMENTS YOU POST OR ACCESS AND FOR YOUR CONDUCT ON AND OFF THE SITE. IN NO EVENT SHALL APPLYFIRST.CA, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AFFILIATES, AGENTS OR ADVERTISERS BE LIABLE FOR ANY DAMAGES WHATSEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTINITIES, OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OF APPLYFIRST.CA, INABILITY TO USE APPLYFIRST.CA, WHETHER BASED ON WARRANTY, CONTRACT, ORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT APPLYFIRST.CA IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
APPLYFIRST.CA’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLYFIRST.CA CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, OR, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $200.
Indemnity
You agree to defend, indemnify, and hold harmless applyfirst.ca (and its officers, directors, employees and agents) from and against any third party claims, actions or demands (including, without limitation, costs, damages and reasonable legal and accounting fees) alleging or resulting from or in connection with your use of the Site, any Document posted by you, or your breach of this Agreement. Applyfirst.ca shall use reasonable efforts to provide you prompt notice of any such claim, suit, or proceeding and may assist you, at your expense, in defending any such claim, suit or proceeding.

Such linked sites are not under the control of applyfirst.ca and applyfirst.ca is not responsible for the contents (including the accuracy, legality or decency) of any linked site or any link contained in a linked site. Applyfirst.ca is providing these links to you for convenience, and the inclusion of any link does not imply endorsement by applyfirst.ca of the linked site. Applyfirst.ca is not responsible for the copyright compliance of any linked site. Termination

Termination of this agreement will not end those provisions that are capable of continuing the ending of this agreement.
Other
These terms and conditions shall be governed by the laws in Canada. The parties agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction there.
General Promotion Terms and Conditions
1. Information on how to enter and prize(s) form part of these terms and conditions.
2. Entry is open to residents of The United States of America who are 18 years or older. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies and partners associated with this promotion and their immediate families are ineligible to enter.
3. Prize(s) are not transferable or exchangeable and cannot be converted into cash, unless cash is the prize.
4. Applyfirst.ca reserves the right to withdraw this promotion or any part of this promotion should their ability to fulfil due obligations be limited at any stage by any form of technical failure.
5. Entry into this promotion implies full acceptance of all terms and conditions.
6. The winner(s) will be notified by email. Inability to contact the winner(s) within fourteen days will result in the prize(s) being forfeited.
7. The winner(s) consent to their name(s) being used for public relations purposes relating to this promotion.
8. Promoter’s decision is final and no correspondence will be entered into.
9. No responsibility will be taken for late, lost or misdirected entries.
For the purposes of this agreement the words “applyfirst.ca”, “applyfirst.ca Limited”, “We”, “Our” and “Us” refer to applyfirst.ca Limited and “Site” to materials delivered on www.applyfirst.ca
